The woman drove away with a cup of hot coffee between her legs and she tried to pry the top off WHILE driving. There is NO excuse. Hot Coffee is HOT. Sometimes near scalding. DUH. 20 years ago a judge would have thrown that right out of court and deservedly so. That excuse you came up with is from the lawyers and the idiots that want rules on EVERYTHING.

Like I said you don't appear to know why the decision against Mcdonalds was made...but than again with you it does not surprise me.

McDonalds would keep their coffee 40-50 degrees hotter than the standard.

The standard rate of most places serving coffee would not cause third degree burns where McDonalds would...even a witness for McDonalds admitted it.

They have also been sued many times before for the same type of thing but just blew it off, the courts also blew it off. They had been advised to lower their coffee tempature to the industry standard in the past to prevent these types of injuries...but they did not.

The juries award initially was done to send a strong message to McDonalds to start trying to follow the industry standards to keep something like this from happening again.

Furthermore the cut the amount of money the person was seeking because they said a percentage of the fault was with the lady herself.

Another thing...Many people thought the lady would 3+ million in her suit but she would up getting about half a million but later settled out of the court for I could only guess would be less.

3rd degree burns over 6 percent of the body should not be caused by a standard cup of coffee when an industry had been advised, sued and warned to lower their tempatures multiple times.

One last thing...EVEN if she got the full amount of money do you realize that Mcdonalds would make up that money in about less than a week from coffee sales alone.

So frivolous or not on the ladies part (which I won't argue that situation) someone should not get third degree burns over 6 percent of their body for spilling a normal cup of hot coffee. And the judgment was more to punish McDonalds than it was to reward the lady. McDonalds had many chances to fix the problem with the temperature of their coffee. They had gotten away with it time and time again but finally a jury said they needed to be held accountable in order for them to change their methods.


Also just to prove you don't seem to have read up on the case. The woman was NOT driving, her grandson was. He did drive away but came to a stop outside of the drive through area so she could put some cream and sugar into the cup. The car was at a stop when she pried the lid open and it spilled everywhere. So neither was the car moving nor was she driving.

BP, I haven't read up much on that case either, but if a jury awarded damages to the lady, then the judges and lawyers aren't the only "idiots," despite what Burm would have everyone believe.

Seems to be something more there Burm... unless EVERYONE not named burmafrd is a moron.

Bottom line is that anyone STUPID enough to do what she did deserves nothing. Bottom line is that hot coffee is hot and too bad if it is too hot. Go somewhere else. You are a typical mouthpiece. WHich to me is like dog crap. Avoid if possible or scrape if off of your shoes.

But I guess that gets excused, since they are saving the country....

Your issue isn't with lying; its with lawyers. I guess at some point, one didn't do as you expected him/her to do....or you are just jealous that they are (most likely) well off... (which is what it sounds like; jealousy)

Face it a majority of the people in this country are not very fond of Lawyers, the profession ranks right above Politicians and Car Salesman. No doubt there are good lawyers with good ethics out there then there are your ambulance chasers and some other low life’s in this profession. I'm sure there are some good politicians as well, I doubt there are many good car salesmen though. :laugh2:

Politicians take both a fair and an unfair beating. The way the current system is set up, politicians have to spend most of their time trying to get re-elected. That's on us, really. The public is, generally speaking, less aware of politics today than back in the 1780's.

As a result, not only do we fail to hold our politicians accountable, we fail to actually make them better politicians by doing so and becoming more informed of the issues and not actively participating in the process.

Two-Way street.

There is a reason its a two party system....and nothing, really, seems to get accomplished. We allow it.

Right winged Christians piss me off with their rhetoric; left wings drive me nuts with the way they want to allocate funding. I wish a 3rd party would emerge.

I'm just saying that public opinion about lawyers is not very high, really nothing to debate on this it is what it is. Lawyers have never been well liked

To be honest, I've never bought a car, so I wouldn't know.

So I can't really comment. My only experience in dealing with them is when occasionally my dad takes a vehicle in for service and I go along to give him a ride back after we drop it off. And since its a local dealership and my parents have bought several cars with them, they've always been pleasant in dealing with my parents (from what I've seen and what my parents have said).

1) You don't know me. Check your rhetoric accordingly.

2) You clearly have no clue how lawyers truly operate. "Required to lie?" Lawyers usually don't testify, witnesses do.

3) Lawyers have stringent codes of ethics. Probably more so than your profession. Did you have to take and pass a test on professional responsibility before you started working at your job?

Are there some who violate those codes? Of course. But only a bigot would damn a whole group of people for the mistakes of few.

Tell me, have you ever hired a lawyer? Have you ever had professional dealings with one? I really want to know. If yes, what happened? If not and your basing your opinion on what you've seen on Law & Order and Court TV, then I'll treat your opinion accordingly.

Typically the people screaming the loudest are the one's who have no idea what they're talking about.

EDIT: And another thing. Just about every profession has people in it who are less than admirable. Clergymen, car mechanics, doctors, taxi drivers, the cable company, the oil business, accountants... I could go on and on.

But hey, I realize it's easy to bag on lawyers, because a) they generally make a lot of money, and b) they're in high profile positions. All I'm saying is if you want to go beyond joking, you better know what you're talking about.
