TAMPA, FL -- New Orleans Saints safety Dwight Smith will not face charges stemming from his March arrest for allegedly pulling a pellet gun on two fans who approached his car outside a fast-food restaurant.
The Hillsborough County State Attorney's Office opted not to bring charges, saying it could not determine if Smith was the person actually holding the gun.
Smith, who was originally charged with aggravated assault with a weapon, was with the Tampa Bay Buccaneers at the time.
Smith pleaded guilty in 2003 to pulling a gun on a motorist. He was fined $225, put on a year's probation, ordered to take anger management classes and complete 25 hours of community service.
Smith returned two interceptions for touchdowns in the Bucs' 2003 Super Bowl win over Oakland. He had three interceptions and 83 tackles last season, playing all 16 games for Tampa Bay. He signed a reported $25 million, five-year deal with New Orleans less than a week after the March 1 incident.
David Roston, a friend of Smith's who allegedly punched one of the two fans who approached the vehicle, also will not face a battery charge related to the same incident.
Smith's agent, Drew Rosenhaus, did not have any immediate comment Wednesday.
