Evidence from Greg Hardy case now in lawyers' hands

Greg Hardy's lawyers have obtained the evidence used in his first trial where the Carolina Panthers' defensive end was found guilty.

Hardy was accused of assaulting his ex-girlfriend, Nicole Holder, but Monday the charges were dismissed when she was a no-show in court.

Hardy's 911 call, photos of he and his his ex-girlfriend's injuries could have been used in the second trial. They were being kept at the Mecklenburg County clerk's office.

Wednesday, Judge Robert Sumner issued an order saying all the evidence in the Hardy case should be returned to the lawyers that submitted it. Even though the lawyers had 30 days to pick it up, paperwork shows they picked it up right away.

The judge who dismissed Hardy's charges also signed a court order saying the court clerk should turn over all the evidence to the district attorney and Hardy's defense team.

Receipts show Hardy's team received his 911 call, a CD with surveillance video from his building and photographs from his bedroom. The district attorney's receipt shows he received photos of the couple at different events, photos of Nicole Holder's injuries taken by a police officer and by a friend's cell phone in the hospital.

Those dozens of photos of bruises on Holder's elbow, back, arms, foot and ankle that a judge saw in July are now with the Mecklenburg County district attorney's office. WBTV requested access to the Hardy evidence file and was told it would not be released.

WBTV's media partner at the Charlotte Observer is reporting the NFL will bring in an outside advisor to review Hardy's court record as part of its investigation. But will they have access to the evidence?

If the evidence was made public the NFL would have no problem reviewing everything. The NFL can file a motion with the court to try and gain access to the materials. They also could reach out to the lawyers involved to see if they would be willing to show the materials they now have in their possession.

The NFL might not be able to speak with Nicole Holder. She made herself unavailable to the DA. We'll see if the NFL will have the same problem.

dallascowboys2080: im sure about that. people are just trying to be objective here. not all the time is a guy in the wrong just because he has balls and a bat. i mean usually they are but sometimes females are crazy too and gold diggers. it seems like both parties are in the wrong from all the reports if you do some diggin more than what the national media is feeding us.

thanks! well lets see if those photos get out to the public. if true than its pretty damming. why aren't they being released? if what happened to nicole was entirely hardys fault why did she not show up for trial? she got paid? really? it should be a slam dunk case for her if hardy is all in the wrong.

Not to ignore the seriousness of domestic violence.

But I have asked a few female friends of mine about these cases.

First question: How bad of a "monster" is Ray Rice, when the girl he hit, went on to devote her life to him?

And,

How do you explain a woman who was beat by a man, taking money in exchange for her silence? Wouldn't any decent, "Honest" woman want to ensure that the man who beat her, wouldn't be able to do this to her or any other woman, again ?
Instead of getting......................Money?

They don't really have an answer? Isn't the issue of Domestic Violence greater then their particular bank account or happiness?

Listen, by no means is this girl an angel. I mean to be with a loser you almost have to be one yourself. My point is that no matter what a girl does, says or her actions are it should never lead to getting beaten. He did everything to her other than punch her. I can't even believe I have to sit here and discuss this. A giant of a man vs a girl. Come on man, really? Need I say anymore?

Really? A lawsuit and court and time=money or an easy silence settlement? A settlement that I am sure was MORE than enough to satisfy her to go away. I mean look at it from Hardy and his teams standpoint. An NFL contract worth 40 million dollars in guaranteed money. Of course you are going to throw something from 1-3 million dollars at her to go away. Read the facts, they couldn't even get a hold of her lawyer.

Police haven't said what the fight was about, but according to a report, Hardy's girlfriend, who Channel 9 is not identifying, suffered scratches and bruises but she didn't go to the hospital, according to the report. <(police report)

I can't anymore.....so you want significant bruises? I mean come on man. We don't even know how bad they are. Maybe they are significant. To me any bruise on a lady should be considered significant.

I don't know. I don't really care about Greg Hardy. I don't think he's a great person. From everything I've heard it sounds like he's an awful person. But I'll root for him in the fall because I'm a Cowboy fan. But just like Pacman, I'll have a short leash with him. If he acts up I won't hesitate to say that he should go no matter what he does on the field.

that very well could be true. no doubt. but the other angle is. she failed to appear. i think there is something in the law against that and there is a fine for that? so a person who fails to appear to a jury trial becasue they get paid off is not a money grubber what so ever? the suppose violence against her and convicting the person victimizing that person should be worth more than any money. justice! whats with her story not adding up? have you heard about that?

I don't know. I don't really care about Greg Hardy. I don't think he's a great person. From everything I've heard it sounds like he's an awful person. That is my point. Root for the Cowboys and root for him to produce for us but for those who are trying to justify his actions just stop. You look and sound silly.

What's he doing with these assault guns he reportedly threw her on top of? That's tank Johnson alarms right there. I'm not going to go real in depth because I made my feelings on the Cowboys and the NFL known yesterday as it pertains to these issues.

where is all the evidence of what Hardy did to Nicole Horder? Skip was talking about the cops measuring some wounds? Anyone hear anything about that?

The cops cataloged a dime size bruise on her arm. there is a tweet incourt follow along of the bench trial over at the charlotte observer. the judge references pictures from the ER which she relates to being able to see bruising too.

I think Hardy meets the standard for assault. He did not really hurt her but its obvious that he was being physically menacing and threatened her at the very least. I think the misdemeanor was appropriate.

What I don't get is why the girl gets off free. She threw the shoe and hit him in the face. He had a cut under his eye. Two days before he left his house and stayed somewhere else. The police arrived as he was leaving. The cops described her as ranting and trying to block his car from leaving, and kicking the car door as he left. It was drug fueled but that certainly is not a pass.

I don't really know what people are trying to accomplish with their outrage over the misdemeanor. I see no predatory behavior on his part.

There is no evidence or acknowledgement of a settlement by either party. Ms Holder was an uncooperative witness from the very beginning. She didn't show for the restraining order hearing the day after the incident and had to be dragged to the first hearing. Just because she didn't show for the jury trial doesn't mean she was bought off.

I don't even recall hearing about a civil suit to begin with, let alone a settlement. It is possible there was an agreement, but it would be confidential and could not legally keep her from pursuing the criminal charges. That would be a crime by itself. The fact that the DA mentioned a settlement as the reason for dropping the charges was very unprofessional. It's not what you know, it's what you can prove.
