Failla is the district court judge. Whomever loses (which she has made clear the NFLPA will lose) has automatic rights of appeal to the 2nd Circuit Court of Appeals, so they don't need "grounds for appeal." CA2 would be starting fresh so the earlier conflict of interest would not be a factor.
Well, I think she still has to rule on the merits of the case itself so I think she is still the judge assigned to it. While the ruling she issued earlier this week makes her opinion clear, the order she gave didn't actually give the league the confirmation they are looking for.Exactly. This restores so much of my faith in the justice system.
That prior ruling was so biased and utterly lacking in credibility, it's good to see all is not lost.
I just don't see anything in the ruling granting the NFL's motion to confirm. While she essentially says the NFLPA's case sucks, the conclusion to her ruling states:I think she he did rule on the merits, although incorrectly, and denied the request for a PI. She then gave the NFLPA 24 hours to appeal her decision to a higher court, which is whats happening. It's not going back to her unless the Court of Appeals remands it back to her.

I do not see anything that grants the NFL's motion to confirm the arbitration award.

This works out very well. I think trading missing the Chiefs game for the Raiders is key. Suddenly, the 6 game stretch he'll miss seems very reasonable (not easy, but reasonable).
