So if she is not required to be there and her testimony is also not allowed, then what are they appealing?

Also, could this help Zeke once they make it to court? In court, they can't challenge the verdict or information, it would have to be about the "process". In my opinion, disallowing her testimony in the appeal is an unfair process since her testimony was the ENTIRE consideration for the suspension.
I agree.

This ruling actually is ammunition for Zeke in court. It speaks to the unfairness of the process.

why is Zeke even attending the hearing then? why waste your time if they, basically, don't want to hear your side of the story?

stay home and practice, do something productive
Is Zeke even required to attend? If not, he should just send his legal team.

It's a he said/she said case where there is evidence of her lying and evidence of her being in a bar fight with another woman. How do you prove that
Zeke hit her without actual video of the incidents. Zeke's other argument is that the NFL's policy has resulted in disparate and unequal treatment for the same offenses as the Brown and Zeke Case evidences. The only thing the NFL has going for it is that the NFLPA folded in the CBA like a cheap suit in the middle of humid weather.
When they go to Federal Court, it will be about the unfairness of the process, not the re-litigate the facts. It will not be about what Zeke did or did not do, but rather how the 6 game suspension was arrived at.

Like the Brady case, the court case was not about whether not not Brady deflated footballs, it was about the process.

Yes, RXP is correct.

Any court case will be about the NFL violating Zeke's rights. The CBA does limit the players rights and the courts do recognize the CBA as a legit contract.

It is possible that a court could subpoena the girl to see if the NFL accurately got all the facts from her but the focus of a court case won't be on deciding if she lied, etc..

No way.

This was about PR plain and simple and they've gotten a lot of positive commentary from the anti-abuse crowd. If they cut it to one or two games, they'd be admitting it wasn't DV and the anti-abuse groups would go crazy.

They are going to make a court issue against them. I can guarantee that they already have their filing papers written up and as soon as Henderson issues his ruling, the league office will have their attorneys file in NYC and a favorable court for them.

I would continue to fight it even if they reduce the length of the suspension. Once they reduce it, they can't go back and lengthen it again, so Zeke would have nothing to lose and a lot to gain (reputation) by fighting it.

This is pro-forma. It's going to court, where there's it'll be established that Goodell has every right to make terrible decisions.

Unless Elliott's team finds a clever legal angle, the best that comes out of this is a well-deserved PR disaster for the NFL that becomes a landmark issue for the next CBA.

I think Henderson is giving Zeke ammunition for his court case. The only thing Goodell considered in giving out his suspension was Thompson's testimony. By disallowing her testimony to be a part of the appeal, he is creating an unfair and unjust process. How can you appeal a decision if you can't dispute the information used in making said decision?

She's willing to do anything for money it seems. So pay her to tell the truth. Pay her to tell the NFL she made all of this up and that she lied to get money from Zeke.

I'd love for this to happen. Of course it won't. But it will solve everything real fast. And put the NFL and Goddell in the hot seat.

The NFL letter re the suspension suggests that they didnt rely on her testimony to make the original decision as she is unreliable. Instead it suggested the decision was based on the physical evidence which was reviewed by experts.

This is not a he said/she said case. It is all about the expert opinions on the physical evidence.

I doubt we see it go to court.

Based on everything Jerry Jones has *not* said about this issue, I'll be shocked if it does not in one form or fashion. I expect Jerry's going to legally challenge the league's authority to upset the competitive balance in some form or fashion on behalf of the Cowboys.

He's been way too quiet about this otherwise. Say what you want about Jerry, but he's not a guy to cross lightly.
