I've only been around the legal profession for 5 years and I could do a better job advising Goodell on how to do investigations, discipline, and appeals hearings.

While I understand a commissioner generally follow this wishes of the owners, occasionally you have to take a stand. No need to review the erattic pattern of discipline of Goodell.

The owners don't care. Goodell is making them billions.

The NFL has been swinging wildly based on public perception for about 5 years now. A tightening of the CBA is needed for both sides honestly. I think if a good number of people believe that Brady and the Pats cheated, yet again, and get to go free it hurts the integrity of the game to some extent. Shore up your process NFL and try and come up with a set of rules that covers minimums and maximums for most things like you've done with the JDA.

I think that's quite a stretch because the end result here is the NFL and Goodell is totally embarrassed again. This after being dealt blows in the Peterson and Rice cases.

not really, did the judge not read the wells report? was it not referenced? I get in theory that this was about the process, but you can't separate it from the evidence. If there was a video of Brady talking about the plan to deflate footballs talking about "I don't care if I am suspended 10 games, I want to win" then I think the judge would have thrown out this lawsuit.

of all the litigation in play with the NFL, I thought that this one would be the one that the NFL would win. Honestly, I don't see how they screwed this up because I think it's pretty clear that Brady was guilty. This is not good for Football IMO.

Judges are the last bastion of protecting the process, which includes everything all the way up to the constitution.

Although "due process" can be a nebulous term, it really comes into play with everything under the law -- including matters that are not statutory in nature, like arbitration or administrative matters.

The Judge wrote it in his ruling. Arbitration, particularly collectively bargained arbitration, is not something that courts step in and get a hand in the jar ordinarily because it isn't statutory. But when you bungle it up so badly that you've essentially committed a harm to a party or abridged what are otherwise considered inalienable rights under the XIV Amendment, the court's going to slap you down.

I'm sending my resume to Goodell. Haha.

Judges and all attorneys love procedure and precedent. Some matters will establish precedence but careful consideration to due process and the law needs to be taken. I have been practicing law for 16 years and agree with casmith07 that the incompetence of the Leagues in-house and outside counsel astounds me. Truly astounds me. Derinyar, you are correct in stating that the NFL needs to shore up the process. Codify the rules. Make punishments uniform. NFL and NFLPA both pay for outside counsel to draft League Policy and pay for true independent arbitrators.
