It could be rationalized that way.

Poetic justice? Probably, although I think, even poetically, the penalty Foley had to pay was extremely severe, and endangerment is not equivalent to being actually shot, which leads to...

actual justice...not so much.

yes they are and people that think they aren't are willing to void all rights as an american. Policeman is a job no different than any other job. Cops that think they are some kinda super hero that the laws of the nation don't apply too shouldn't be cops. They are just people, any idea beyond that is ridiculous, a cop off duty is just like any other person walking the street. yippee you got some training but the fact of the matter is you have no authority in the nation lest that badge and uniform are on, there is nothing beyond that. A cop is a cop only when on the clock, if they think they are more than that, thats a direct violation of the trust put upon then by the the people that pay thier salary. Clock in clock out and live with it other wise find another way to pay your bills.

That may well be your opinion, but if I'm at the bank and a guy sticks up the bank and shooting breaks out. I'll be pretty pissed if there was an off-duty officer on site and his response after everything was over was "I wasn't on the clock."

Officers live a different type of life and I applaud any officer who believes his job doesn't end, just because his shift did.

in that stutuation that cop would be justified to pull his gun, but the facts in this case arent the same. He was unmarked and decided some guy was drunk and shot him, even if foley was wasted there was no need to bust a cap in his butt three times. A cop saving people is one thing, a cop abusing his power is another. the two situations were complete different, I know for a fact every driver in america had done something stupid once in their driving career, foley might have been drunk but if he had just screwed up nothing would be different. The dude still got shot three times cause some guy that had a badge though he was god. Screw that.

If I drive drunk (and I have)....anything that could or would potentially have happened to me, I would have coming.

I knew the risks when I did it.

So did Foley.

But that's not really what you said. You said if he wasn't on the clock and in uniform, then he has no authority to be a cop let alone carry a gun.

every job I have had even when I was pizza guy once I was off the clock I wasn't a pizza guy anymore, that ****** doesn't understand that. I hope he goes to jail for a while
I've been following this story for a while and I know that the officer made several mistakes in following protocol, but him being concerned about a drunk driver on the streets isn't one of them.

When he saw Foley weaving thru traffic, he called for back up. When he went out his jurisdiction, apparently he tried to reach some of the locals. His first mistake was trying to pull them over when he had no police markings on his vehicle. And his biggest mistake was trying to arrest Foley AFTER they had pulled into the driveway of his residence. He didn't have authority and IMO, he should've just moved on, waited until some locals arrived or at least had some video evidence to show that he was indeed driving drunk and reported that.

That said, this was not a guy out there playing hero. He was trying to do his civic duty and he messed up.

The fact is a Police Officer is never off duty, I have made arrest at work and off of work and I have made arrest on my way to work. I 'm not going to go back and forth here in the cowboyszone about law enforcement pratices. If this upsets you so much contact the U.S. Attorney's office since they were the ones who prosecuted all my cases.

That is correct, a police officer is always on duty regardless if he is in uniform or not.

that's all well and good but how many people have you shot three times off duty?

and to be honest, I don't agree that a cop is always on duty, unless someone's life is in danger I don't think you guys should be treated differently than anyone else.

The problem I have with the whole foley thing is he shot a guy three times when he got out of his non marked car, in front of foley's house. That's all shades of messed up.
