Too lazy to be sure, but violating those laws is likely to be a felony and that would definitely put him in jail for a decent period of time. He'd have to be extra mindful to never allow guns near him. Given his behavior (these incidents), he hasn't been acting mindfully...

I'm sure Dez isn't surrounded by the most honorable, higher class people. He has his thug friends who hang around and use him for the spoils of being rich. Dez was not exactly raised in a stable home either. He went from the poorhouse to a castle almost overnight.

Most young athletes do not know how to handle family and friends when they make it. Sounds like an argument with his sister so far and things got heated. Maybe she was demanding money, maybe he laid out some rules she did not like and she went crazy on him. Point is..we don't know what is going on in his home, a number of different things could have happened.

One does not have to attack anyone physically to get arrested for DV, he could very well been defending himself in an attack and held her down to avoid an injury, who knows.

Dez has had his off the field problems and needs to surround himself with better people IMO because the public is always watching and waiting for something to happen.

I expected much worse when I read the headline, but he's got to clean his act up. I'm sure the team is getting tired of it.

From what I have read it is a simple assault it could be the threat of harm.

The elements of a domestic violence assault are the same as the elements of simple assault on any other person, as set by the Texas Penal Code. They are:
1. Intentionally, knowingly, or recklessly causing bodily injury to someone else.
2. Intentionally or knowingly threatening someone else with imminent bodily injury.
3. Intentionally or knowingly causing physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative.
You can see that it doesn’t take much technically to constitute simple assault. Poking someone else in the chest a few times during an argument can be considered assault under Texas criminal law. However, if you use a weapon or cause serious injury, you can be charged with the much more serious aggravated assault

Wont happen because he obviously isnt that bright. As far as the second comment, they never seem to have to wait very long.

You really most traffic violations are misdemeanors. The context of this needs to come out before judgement is passed, No details except a twitter feed and a headline on a news program. Heaven for bid he goes to the grocery store and drops a bag of confectioners sugar in his driveway. "Dez has suspicious white powder under his Escalade"

They have three classes of misdemeanors, though...with Class A being the worst.

As I posted before, here is a legal definition of a Class A misdemeanor:

Some examples of Class A misdemeanor offenses include assault causing bodily injury, driving while intoxicated second offense, theft of property valued at $500 to $1500, and resisting arrest.

If I'm interpreting that right, it's not just "assault" that gets you in the Class A category...it's assault "causing bodily injury" that does.

The trouble is that it would be under Dez's Escalade... Not under Romo's... Not under Austins'... Not under Ware's... Not under Ratliff's.

Sooner, rather than later, the Cowboys are going to grow weary of this sort of thing.

But the thing is the cops dont normally go in looking to arrest someone. From what I have heard and seen they try to calm the situation and end in a warning vs. looking to bust in the door and start slapping on the cuffs.

From my understanding of the link below is if its a simple assault but domestic in nature it is Class A in texas. Unless its a 2nd or more offense.

It depends on the municipality. I have been in places where if a cop is dispatched for DV someone is going to jail even if its for the night. You do realize it only takes a party in the altercation to say, "I want him arrested" or he TOUCHED me and the silver bracelets come out. DV is like rape in a lot of cases.

Why is everyone getting so mad? Did Dez's arrest somehow affect your life? Did you get fired from your job because Dez got arrested? Did your wife leave you because of this?

*for the record, I think the arrest was stupid, and avoidable. I just LOL when people get so angry over something that has NO EFFECT on their life whatsoever. :rolleyes:
