He failed this time while he was suspended, so yes he will continue to get tested if he wants a chance to get back into the NFL. There might be a period of time during the off-season that they are not tested, but I don't know the details on that.So during this 1 year ban can he be tested again or can he smoke all the pot he wants?

The first suspension is 4 games.Yes. You have to fail 4 times to be suspended. The first three are warnings. The fifth time is 10 games, then the 6th time, it's a year.
