The colts complained about it and a sting was set up or they would not have been caught.
They have been doing it awhile, but for all we know other teams were doing it too.

We wont ever know because the refs were not checking the balls!!!!!!!!!!!!!

The Patriots absolutely are at fault. That doesn't mean the system doesn't have flaws though.
