Looks like there are some fact issues (i.e., "Consent") that would preclude the grant of such a motion. The article states: "Bowers [the plaintiff's attorney] would not say how Jones forced Weckerly to submit to the alleged assault." That said, I have no idea what theory should could possibly use against a 71 year old man.

Under the statute, there are a variety of theories available:

§ 22.011. SEXUAL ASSAULT. (a) A person commits an
offense if the person:
(1) intentionally or knowingly:
(A) causes the penetration of the anus or sexual
organ of another person by any means, without that person's
consent;
(B) causes the penetration of the mouth of
another person by the sexual organ of the actor, without that
person's consent; or
(C) causes the sexual organ of another person,
without that person's consent, to contact or penetrate the mouth,
anus, or sexual organ of another person, including the actor; or
...............................
(b) A sexual assault under Subsection (a)(1) is without the
consent of the other person if:
(1) the actor compels the other person to submit or
participate by the use of physical force or violence;
(2) the actor compels the other person to submit or
participate by threatening to use force or violence against the
other person, and the other person believes that the actor has the
present ability to execute the threat;
(3) the other person has not consented and the actor
knows the other person is unconscious or physically unable to
resist;
(4) the actor knows that as a result of mental disease
or defect the other person is at the time of the sexual assault
incapable either of appraising the nature of the act or of resisting
it;
(5) the other person has not consented and the actor
knows the other person is unaware that the sexual assault is
occurring;
(6) the actor has intentionally impaired the other
person's power to appraise or control the other person's conduct by
administering any substance without the other person's knowledge;
(7) the actor compels the other person to submit or
participate by threatening to use force or violence against any
person, and the other person believes that the actor has the ability
to execute the threat;
(8) the actor is a public servant who coerces the other
person to submit or participate;
(9) the actor is a mental health services provider or a
health care services provider who causes the other person, who is a
patient or former patient of the actor, to submit or participate by
exploiting the other person's emotional dependency on the actor;
(10) the actor is a clergyman who causes the other
person to submit or participate by exploiting the other person's
emotional dependency on the clergyman in the clergyman's
professional character as spiritual adviser; or
(11) the actor is an employee of a facility where the
other person is a resident, unless the employee and resident are
formally or informally married to each other under Chapter 2,
Family Code.


Apparently she was the one taking the photo - not in it

I can't see anything happening over this, but I will say the timing is bad to get hit with this the same week Goodell is being called soft.

Idiotic lawsuit...she said herself that "there was a lot of alcohol" and that she couldn't remember exactly what happened. Now, 5 years later, she's remembering stuff in explicit detail lol. Not to mention any issues of non-consent will be undermined by her actions/facial expressions/body language in the photos. And lastly, as someone else already mentioned, how was she "forced" to watch Jerruh and the other young woman? Hell, just close your damn eyes....unless Jerruh used those thingamajigs fron A Clockwork Orange:

Sorry, Cowboys fans...if anything this suit will probably rally support for the ol' geezer lol. He'll feel emboldened after it's either tossed out of court or she loses outright. He'll say "How about them Cowboys?!" as he leaves victorious from the courthouse.

Very likely the real threat here was the shake down to keep her from filing in the first place. It sure seems like something that's likely to come down to he-said, she-said, where the 'he' is a billionaire' and the 'she' is a former exotic dancer.

She will get a lot of money to make this go away probably & I'm sure Jerry is very pissed but the fact is he puts himself in these situations.

Taking pics with young girls. Drunk in public at clubs. He can do whatever he wants but he makes it super easy.

I'm sure he has a lot to do. Maybe he should spend his free time at his own house with his grandkids. Maybe?

He'll never live this down. This will go down as one of those Jerry drunk stories like 500 coaches could coach his team.

LOL, this is too funny. too funny. he is accused of something he supposedly did 5yrs ago, after some idiot posted photos saying that he was God. . so I am willing to bet he found this woman and talked her into filing charges so they can get paid, well hoping they will get paid. but They will end up getting nothing.
Goodell better not even think about trying to do something to Jerry over this nonsense.

All you numskulls that want Jerry gone are numskulls. Geez go find some other team to like. I am tired of all the get rid of Jerry, get rid of Garrett, get rid of Romo , how bout you make it all easier and get rid of yourselves that way you will no longer feel upset with the team and for us that stand behind our team thru thick and thin we will not have to suffer thur your childish rants

There might be a 5 year civil SOL on sexual harassment - which might be what the timing of this suit is about. Unfortunately, there is no statute on management incompetence from a fan perspective.
