?????. Really, what NFL cases, regarding player misconduct, have gone to the SC????
None. Who cares, til we get close, but @FuzzyLumpkins brings things to the table and we either eat, or try the samples at the table with guys tossing spears at us which we either accept and understand, or just nod our heads and try to get home before ish gets too thick.

You can call it arrogance and whining, but they have a very strong case. The whole *point* of arbitration is to keep the courts uninvolved. If a court allows people in arbitration to file suit even *before* a ruling, it defeats the very reason you have arbitration in the first place.

That logic does not apply to this situation.

Elliott's legal team made it crystal clear in their original filing that the arbitrator's "ruling" was irrelevant to said filing. The "unfairness" to Elliott had occurred in full by the conclusion of the hearing (but before the arbitrator's decision).

Based on the evidence, the judge agreed that the case was indeed ripe prior to Henderson's official decision (which was clearly just a formality).

There has been only two litigated PCP cases under the current system. Bountygate and Brady. They went different ways. None has gone to SCOTUS. A former federal judge arbitrated Rice and found in his favor. Tagliabue never had this issue when he revamped it.

However if you look at the broader scope of NFL litigation over the past 50 years the NFL losses a lot. I cannot remember a single SCOTUS case they have won and several they have lost off the top of my head.

so let's recap:

Goodell hands down suspension -----> NFLPA appeals to district court (Mazzant)
District court (Mazzant) grants PI -----> NFL appeals to 5th Circuit

so what's next based on outcomes, zone law dogs help us out:

5th Circuit grants stay -----> NFLPA appeals to SCOTUS?
5th Circuit grants stay -----> NFLPA can't appeal, case moves to New York for further litigation? (based on ruling more appeals?)
5th Circuit doesn't grant stay -----> NFL appeals to SCOTUS?

just trying to understand what each side can do after a ruling either goes in their favor or not at each step in the process

SCOTUS i think is the end of the line, but what has to happen to get there?

I'm not sure what is confusing. The narrative nowadays since Brady has been what you said but they lost the other two cases reviewed outside of the typical Goodell railroad in BountyGate and Ray Rice.

You also spoke in general terms that the NFL most often wins in higher court but if you look at the history of NFL's litigation against players it does not bear out. You moved your argument to personal conduct but a single appeals case does not indicate a trend.

You ain't kiddin. Be so entertaining...bit of travel though!!
This should get organized- in any way organized... With the full force of Us- Yes? And something real gets going for it???
You got me. Let's make a monster show of it.
I'll work on the few that we truly want to be there, but I'll try to be like a Risen Phoenix, rebelling against poor, British Alexanders who think queuing is a metaphor to life.

I know I'll be there. Dallas... Austin... Phoenix... Wherever.

In the end we're going to lose this I'm afraid.

I must not fear.
Fear is the mindkiller.
Fear is the little death that brings total obliteration.
I will face my fear; I will permit it to pass over me and through me.
And when it has gone past I will turn the inner eye to see its path.
Where the fear has gone there will be nothing.
Only I will remain.

Nothing like a little poetry to confuse the issue even further.
