definitely have him for Cards and Rams games, theoretically could lose him for Packers and other 5 games if 5th Circuit grants the stay

still believe Zeke ultimately wins
Then what will they do about suspended games if he wins?
 
We all know how this is eventually going to end.....Zeke is going to have to serve the suspension, question is this year or next

Remember, before anyone panics: the material FACTS of the case do not change on an appeal. New *evidence* is not being introduced in this appeal.

Kia Roberts' findings were NOT included in the final report. She was NOT present at any of the key meetings held to make decisions about Elliott's suspension.

The NFL really, really has a tough row to hoe here. They have to convince the appeals court on the merits of the EXACT SAME EVIDENCE that Judge Mazzant saw that Judge Mazzant got this case 180 degrees wrong and that Elliott must be suspended right the heck now.

I'd be shocked beyond belief if there is a reversal here.

In all fairness,you are not clear on what is being evaluated by the courts. The courts are evaluating procedural fairness, not guilt or innocence of DV or violence. Evidence related to DV has nothing to do with the case going forward.

No, I Totally understand Zeke's side here

Just saying that the NFL is a corporation with its own rules, which apparently take precedence over the spirit of law, and I feel the deck is stacked against Zeke here. And it sucks

In the end we're going to lose this I'm afraid.

I actually think he's gonna win this case. But here is the rub...the league then can turn around and suspend him again for pulling the top down on that girl that was caught on video.

And we can do this whole fiasco all over again...That's how I see this playing out. It's gonna be months...if not years before this is over. The NFL wants to punish us for questioning the leagues authority. Well....Elliott sure gave the league the ammo to do it. :rolleyes: DumbA**:mad:

We can all cling to the hope that the NFLs ridiculous investigation and arbitration will negate the suspension, but we all know-deep down- that the courts will favour the billion dollar corporation over the individual.

Yep. Rog is judge, jury, and executioner. The NFLPA gave him that power thru the CBA. Sadly!

Given the use of term credible evidence in the new DV policy those two notions are not necessarily mutually exclusive.

Spirit of the law? There are provisions in labor law that deal with shop precedent and fundamental fairness that the NFL cannot ignore. Mazzant laid that out very clearly.

This case will be a waste of their time in THEIR eyes.
They have much bigger fish to fry.
There is a slight possibility that the courts will see Goodell/NFL as the big fish to fry. They keep having cases land on their desk, accusing them of wrong doings.

Exactly, since they're lacking an arrest or conviction, as written in the CBA.

As others have stated over and over in other threads and @rat2k8 stated correctly in this thread this case is not the Brady case and shouldn't be thought of,at all, as the same type of case.

One is a criminal accusation where the lead investigators recommendations were deliberately ignored and there was an attempt to hide that information from the accused.

The other is about breaking a rule of the game. The accused did not argue that key parts of the investigation were left out.

In the end, this suspension will be upheld. It's just a matter of when it begins. The NFL, per an agreed upon standard with the NFLPA, has the right to discipline it's employees following the stipulations of the CBA. It will boil down to that point and the NFL will come away with a favorable ruling. That ruling could still be a few courts away.

This will give a black eye to the NFL though and the next CBA will be much more NFLPA leaning IMO. The Goodell era is coming to an end.

Do NYC and I will drive from NE Penna to be there...but, ONLY if the plan is to egg Mara's house during Goodell and Mara's weekly PJ party...I just want to see them come out of the house with their cocoa and feety pajama's and say "heeeyyyy, what was that noise...." then we plug them again, I'll bring the eggs and tomatoes
