Being a manager allow me to tell you right now that I cannot for any reason terminate an employee w/o an investigation being done by our personnel department. Once that is completed and options have been submitted, we decide then the best approach. That usually takes about 2 months to get completed.

But you are correct in that any employee can quit for any reason. Companies are not however "employees" and we have strict employment rules that we have to follow per federal employment guidelines.

Have you ever managed a staff of more than yourself? :) Who did you work for? I would like to go see the policy about firing employees.

And before you start chest pumping your labor law rules w/ everyone.

How many union labor laws have you dealt with?

Probably none?

Oh lord, my new boss is a 25 year retired Army and this is his first civilian job. You want to talk about adjustment.

We have a lot of issues w/ ex military coming over to the civilian side and trying to be managers after they retire from the armed forces. They always alway ALWAYS get into trouble the first couple of years until they figure out they can't bark/order/intimidate any longer and that the employee has rights.

Good guys though. Breaking those habits are hard to do for some.

That's exactly what we are dealing with. The office has between 50 and 60 employees. 12 have either quit or gotten confrontational and forced out in the last 3 months. It's really a hostile environment right now.

Better? Never said that.

More knowledgeable about the law? Sure. But recall that my post was in response to a post questioning my knowledge of the law. It's not as if it were unprovoked.

I hope you're better at interpreting the law than you are normal conversations.

You're not always entitled to quit as an employee. If you have a contract and you quit before the contract, you may have to pay a steep penalty and/or execute a 'non-compete' clause. Technically, you can quit but often at such a penalty that it is not feasible to do so.

As far as what you are alluding to, 'right to work' states really have to do with unions.

You are also conveniently forgetting that bosses are not entitled to fire employees for their race, religion, age, etc. That and I don't think anybody here is believing that they are 'entitled' to a job. More that they are trying to protect their best interests when it comes to their job, which I think any logical person should be able to understand.

I just feel that firing an employee for no reason is bad business on many levels and that boss' 'right to fire' somebody does not take precedent over the profitability of the business and what is in the best interests for the investors and shareholders.

It costs much more money to fire and hire a replacement and if you are firing people for no reason, you are now at a higher risk of being sued because people can make a claim for a discrimination suit and have entities like the EEOC, who will fight their case pro-bono.

Those guys are easy to work with; then again I been in the military so i have an advantage when dealing with them :p:
