Can you explain the difference between the civil and criminal cases? Its the entire issue, please share your knowledge with the group.

It was also reported that the prosecution decided not to pursue it any further because when she was interviewed by them her story varied so much
they would look like fools.

The state asked for the charges to be dismissed after Holder didn't make herself available for the trial. She was not able to be located in order to serve, court officials said.

District Attorney Andrew Murray told the judge his office went through "great lengths" to track Nicole Holder down. When she didn't show up for court Monday, Murray says it appears she intentionally made herself unavailable to the State.

"Prosecutors last spoke with the victim in October and November 2014," a written statement from the DA's office stated. "During those conversations, the victim expressed that she did not want to participate in another trial. The District Attorney's Office has not been able to reach the victim since November 2014."

He said said the state visited her home, employer and even put surveillance on a new home where she was believed to be living. Murray said it would not be just or appropriate to move the case forward without Holder.

In North Carolina, the state could continue without a domestic violence victim, but case would be much weaker. There were inconsistencies that troubled first judge in the July bench trial.

"We are committed to stopping domestic violence," Murray said. "But we also want victims to come forward and cooperate."

The State said it had reliable information that Holder reached a settlement before the trial began. The judge granted the prosecutor's request for a dismissal on the assault on a female and communicating threats charges.

The court released the defendant when a trial was demanded. The legal system, once decided, is the cornerstone of a just system for such things.

To punish, void of actual film and pictures, and no further charges by who is supposed to be victim, puts the NFL in rough to shaky grounds...maybe?

At this point, the NFL owes him an apology. Hardy did the right thing by all accounts. His crime was knowing this crazy biotch.
 
I don't really care if he's a felon, murderer or Saint. If he can rush the passer, sign him.

Criminal and Civil or just what they are...criminal you get punished with jail time, fines, probation, etc and in a civil case it's more about money..damages. He was convicted of assaulting her and communicating threats. 18 months probation. In the Civil trial the witness didn't show so it was thrown out. They were trying to appeal the criminal trial and get a jury.

As far as him...these situations usually are something in between. She was on coke..she admitted this. I think she probably did assault the guy first but I also think he probably threw her on the couch to get her away. So truth on both sides.

Ego, but I think more specifically ridicule. Didn't Chuck Finley catch a lot of flack when he reported that then wife Tawney Kitaen roughed him up (also with her heels). For him to be in the locker room with that story being so public must've been a nightmare.
 
I read somewhere that he broke up with her in earlier that year because she was bad for him. But he had a difficult time saying no to her of course. I think it came from the court transcripts. Reminds me of the Jody Arias story.

Except the other half was butchered in that one...

That are reported. Men are far less likely to report so numbers are screwed. Its all over psychological literature. I know because I'm a professor at Georgia Regents University in the Psychology department and study DV research.

And what % of women don't report sexual abuse or domestic abuse out of fear or from this societal pressure that violence against women is somehow their fault? I guarantee you that number is significantly more than men who don't report out of the same fear. The numbers are skewed, for sure, but only in a way that reveals less of the problem than more.

Him paying her off is not an admission of guilt. You cant say you wouldn't do the same thing in the same situation. Especially after having a judge convict you based on nothing more than her word against your word. As a man you are assumed to be the aggressor. Many awful men before have put me in this light. Lets not pretend that a 6' 4" 290 lb black man who is knick named the Kracken would really get a fair court date against a woman. Lets be honest about this. It sucks but its true.
Convictions are no longer about being proven guilty or innocent. They are about who someone believes a little more than someone else.

Based on the 911 call I would question why this woman wasn't arrested for assaulting Hardy. He clearly called the police to report her for assaulting him and somehow he ends up arrested. Imagine why he didn't like his chances in court.

That opinion presumes you do know what happen that night. Where is the evidence that proves this? Or does that matter to you.

Definitely screwed, but there isn't less of a problem. There is the same problem. Violence is violence. No matter who commits it. More often, both parties are guilty of domestic violence against each other. There is no way to accurately and reliably record any of this.

Hardy reported the assault to the police......where did that get him? Arrested is where.
