Thanks for your comments -- I should preface my reply by stating I am not a lawyer. Your note tweaked my interest regarding the difference between assault and battery vs. DV. This is what I found in the statutes for Colorado:

domestic violence means any assault or battery, aggravated assault or battery, sexual assault or battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any criminal offense resulting in physical injury or death of one family or household member by another family or household member.

If, instead of DV, the alleged victim had accused Lewis of assault and battery, he could have been charged for simply threatening and touching.

What does it all mean? Who knows, but from my very limited view-point, it would appear that without any evidence of physical violence, the charges are either dropped or, at worst, he is fined.
Thank you for your response. I don't know Michigan law. I do know Texas law and all of my comments in this thread are based on Texas law. DV is not a separate crime. DV only enhances the possible consequences of the crime charged.

As far as "evidence" goes, her testimony is evidence. Evidence need not be physical. The jury is free to believe all, part, or none, of her testimony. (And his for that matter). No other evidence is required by law.

In the federal legal system they use "sentencing guidelines" that narrow the punishment and leave little discretion to the judge. Most states do not have such guidelines. Jail, or fine only is stictly up to the one who imposes sentence within the statutorily authorized range of punishment.

Brother, my buddy, a Marine, slapped burning mail out of his girlfriend's hand, that she had lit on fire in a fit of jealous rage and he got 52 weeks of domestic violence counseling (that he was able to do at a Vet Center, thankfully, and the charges were subsequently dismissed). I guess he shoulda let her burn the place down. Or got a squirt gun.

DV is certainly real, but also overblown sometimes.

Can't stand it when people make assumptions without knowing the facts, like some in this thread.
Sometimes! Its a exaggerated to an extent everytime. Pussified society.

Then he figuratively shot himself in the foot. He has the right to remain silent about the incident and let the legal authorities sort the whole thing out... because as the police will tell you, anything you say can and will be used against you in a court of law. Good luck Lewis.

I don't think he admitted holding her down by the head....... that is the whole disputed charge

That is a big thing.

Every case is different, maybe I should have clarified for folks like you. In this case it wreaks of (a select few) people wanting to ***** for the sake of *****ing.

We also have facts quite a bit. Almost always they emerge, eventually. Not sure you're right there, either. Now, this early in an ordeal, sure, hence my point.

No where did I say this was a positive event. Just to be patient. I was positive about it -- two different things, Bob.

But hey, salud, brother.

When the verdict is handed down, and thereafter a punishment (or not) from the league, we'll have the facts. That's my point.
