I still have not heard what Benson's blood alcohol level was. IF it was like a 1.2, that would explain alot. Either way, it sounds like the River Patrol got a little overly aggressive.

If he was arrested for DWI he would have had to submit to a Breathalyzer back at the station....Very rarely do the police use an actual blood test.

Benson never submitted to any test even when he was brought to the station. At least according to the news reports in Austin

If that was the only description they gave me I would ask. Was the person white, black, indian? If they didnt know??? Then anyone in a white T, Blue jeans and dreads would be open to questioning.

Theo....in this situation, do I have the right to refuse questioning simply because I may or may not look like someone?

Yea when I was like 13 I was profiled by a cop. I was carrying a load of laundry from across the street (we did not have a Washer in the house and there was an apartment laundry mat right across from the house). I fit the description of kids that where in a carwash messing around a couple blocks away.

LOL cop ask me what I was doing I said the laundry what does it look like :lmao2: as I held a basket of dry clothes

Lets see they were black and it was a group of them making noise and then you drive to and you see a car filled with a group of black people in the description. The person who made the call metioned nothing about them being in a car. Do you pull them over?
