Would you think they were 'screwed' over by the law?

again, it depends on the dude.

I will admit I am blindly going to bat for dude's I know are decent people.

laws or not, decent people don't belong in jail.

I don't know if plax is decent, but I do know if you were my friend you are decent.

laws are laws, morality isn't related to law.

I guess that's why prostitution, drugs, and animal cruelty are legal and adults are allowed to have sex with minors.

prostitution should be legal, hurts no one.

drugs should be legal, again, if it was legal it would hurt no one but the user

Hurting animals is a completely different thing, as is hurting anyone.

hurting people other than yourself should be illegal.

We’ve been hearing for weeks now that former Giants receiver Plaxico Burress flatly has rejected opportunities to resolve criminal charges that could put him away for a minimum of 3.5 years, even though Burress would do far less time by pleading guilty to a lesser charge.

Bob Papa, the radio play-by-play announcer for the Giants and one of the hosts of Sirius NFL Radio’s The Opening Drive, elaborated on the situation today.

“This is what I’ve been told and what I’ve heard,” Papa said on the air. “They worked out something where they had it down to about a three-month jail term with actually only two months served and about 1,500 hours of community service. And I think his lawyers felt that they had a pretty good deal. He doesn’t want to go to jail at all. He shot down the deal. . . . He does not want to go to jail at all. So now coming up in another couple of weeks we’re gonna find out what’s gonna happen. But my guess is that the city of New York is not gonna back off any kind of jail time.

“Evidently, he’s gonna have to go to Ryker’s Island,” Papa added. “He’s deathly afraid of going. . . . f he would have just taken the deal when it originally was offered it would all be over with by now. But supposedly the community service hours and the jail time are not appealing to him. He does not understand that he is not in any kind of position of leverage. He has no leverage. He — not his representatives — he thinks he has leverage.”

Papa is right on the money. No one wants to go to jail. But when Door Number One entails two months and Door Number Two most likely will slide open to reveal a minimum of 39 42 months, the decision should be easy.

Then again, nothing is ever easy when it comes to Plaxico Burress.

Apparently, he thinks that lawyer Benjamin Brafman will be able to do for him what Brafman did for Sean P. Diddy Puff Daddy Puffy Hufflepuff Bo Diddley Combs, securing an acquittal on identical charges.

But there are two key differences between the two cases. For Combs, the unlicensed and loaded weapon that he allegedly had in his possession didn’t fire. More importantly, Brafman destroyed on cross examination the witnesses who claimed that Combs pointed a gun at them.

For Burress, Exhibit A is the scar from where the bullet entered his leg. Exhibit B is the scar from where it exited. Add a dash of testimony from folks like former teammate Antonio Pierce who’ll confirm that the scars were obtained when a gun in Plax’s possession went off inside a Manhattan night club, and no amount of legal hocus pocus or mumbo jumbo or Chewbacca defenses will keep a reasonable jury from concluding that Burress is guilty beyond a reasonable doubt.

In America, our inalienable rights include the right to irrevocably screw up our lives. Unless someone can talk some sense into Burress soon, he’s about to provide a high-profile manifestation of that right.

Put his *** in jail where it belongs.......cant do the time dont do the crime...I hope he meets atabesse ( OZ reference )

You should totally run for president

Nothing like a bunch of people on PCP or paranoid meth heads running around with loaded guns thanks to your liberals gun control laws, that's a really good idea :laugh2:

LOL! Drugs only hurt the person using them. Riiiiiigggggggghhhhhhhttttttttt.

That must be why people only shoot themselves over their drugs, drug money, and the like and NEVER shoot anyone else over those things.

Oh, wait.

Not really both are stupid choices that increase the risk to people around you, and both are illegal for that very reason.

As dumb as you might think it is, there's a lot bigger chance of accidentally shooting someone if you carry a gun then if you don't

The fact that Plax had an accident doesn't matter, the choices he made that lead to the accident does.

He knew or at least should have known the risks (Ignorance is no excuse) and did it anyways

I don't agree with that law. If he doesn't hurt anybody then jail time is ridiculous, especially on a 1st offense. $10,000 fine for a 1st offense is stiff but it beats jail time. 2nd offense of carrying a weapon in a bar, ok give him 3 months in the can. I agree carrying a gun into a bar is stupid but they did it in old westerns so it's cool.;) j/k

All natural drugs such as (Mushrooms, DMT, Cannabis, Cacti(peyote) ) should be legal. Drugs such as Meth, PCP, and crack should not.

Oh, wait.

The true fact is if drugs were legal, drug crimes would stop. The cartels and street dealers wouldn't be able to sell them because the government has it monopolized. Just look at prohibition. It crippled the mafia when alcohol was made legal. They went on to the heroin trade.

ding ding ding, we have a winner

You are so far off it isn't even funny. If he walks into a club, even with his controlled handgun license, and shoots himself in the leg anywhere in Texas he'll do jail time.

New York has enacted these laws to protect its citizenry from idiots like Plaxico. Many of those faced with the same infraction of possessing an unregistered firearm are only prosecuted for charges that do not include mandatory jail time.

The fact of the matter is that Plaxico was in a crowded public establisment, drinking (brings us back to the DWI mentioned earlier) most likely, and fired a pistol. Of all the great luck in the world, he only shot himself.

Any *ing idiot that brings a pistol into a nightclub where he/she will be drinking needs to have their head examined.

Any *ing idiot that thinks he shouldn't be sent to jail just because he got lucky enough to not shoot someone else should spend some time getting their head examined.

Want to know why no one shares your viewpoint that he shouldn't be in jail? Because every village only needs one idiot.

Placcident not going to jail sets an unjustifiable precedent that you just cannot get your head around. Sorry, but he does the world more good in jail as an example of how no one is above the law rather than on the streets where he can show the kids of the nation that if you are a celebrity, it's cool to carry guns no matter if they are illegal.

He'll "reach" more kids and more adults with child-like minds if he doesn't go to jail than he'd ever be able to speak to one on one.

Let him go, let him go for the full time. Bringing taxes into the arguement is just beyond stupid.

In my opinion, the mandatory sentence here seems a bit excessive. My opinion is probably in the minority.:

None of this is an issue if you have 1 ounce of common sense. Plax is a grown man and knew better but did it anyways. If you willing to do this then be willing to deal with the consequence of your actions.
