If Brady does sue, Kessler will have a much more difficult time beating the NFL this time around. One reason is because a judge that has been favorable to Kessler and the union, David Doty, is no longer hearing cases. Also, the Peterson case being overturned was the legal equivalent of Halley's Comet, as several legal expertsexplained to Ben Volin of the Boston Globe.

Hardly Halley's comet. It was a pretty clear cut case.

And the rumors of him not hearing cases have come about many times. It could be the case now, but I'd like him to cite his source on that.

The NFL has the perfect PSA going to say Hardy, Peterson and Rice were the last ones. Just punish them under the old policy and move on. They are fighting for an expired policy.

That is BR not a reputed source. Second this has been going on a lot longer than Kessler and Doty. Brown vs NFL was filed 50 years ago. SCOTUS also rules against the NFL over the past 50 years repeatedly. It would be one thing if SCOTUS didn't canonize Doty's rulings by affirming them.

Finally, the Haley's comet thing is not even in the article you posted. It says that Doty hasn't retired but is instead is in a senior role. It also points out that there is no precedent before and then points out the precedent that exists. It's not like they changed past rulings. This is just the first time it's been litigated. The NFL lost which set a precedent and there is a legal principle to honor the rulings of other courts.

Well Susan Rodgers I think her name was, saw the Brady case during the lockout and ruled against the NFL. This notion that it is Doty or bust just doesn't stand to history. The court is very clear that the NFL has no legs to stand on absent a CBA. As you say open and shut.

He is probably guilty but LA put on one of the worst prosecutions ever. Harden and Clark played to the cameras and not the jury. The case was too long and they got bogged down with the scientific stuff. They never really showed any motive, didn't have a murder weapon and provided a very small window of time. Add in Furman, Kato and the glove and it was a circus.

Hardy's lawyers were supposedly going to present the case they were never able to provide when the charges were dropped. The said the appeal took over 7 hours, but it is probably a moot point since Henderson has been a rubber stamp in the past. Hopefully someone will provide the transcripts so we can see Hardy's side of the story.

Point being just because someone is not found guilty doesn't mean they're not guilty.

That's exactly what it means. I think what you were trying to say is that just because someone is found not guilty doesn't mean they're innocent.

That's fair, but the other side of that discussion is that it doesn't prove they are either.

True. Everyone has difference of opionons on the evidence. No different than a jury does. I think he did it. Others don't.

I don't know if he did "It" or not. I am not even sure what "It" really is. I think nobody knows enough about the details to say for sure what exactly transpired there.

I've seen enough. A judge seen enough and the nfl seen enough. Others obvious haven't.
