I've actually never heard of that. I've been around quite a few child support cases, and in every one I've seen the child support paymants stay w/ the biological parent. The only exception is if the biologic is willing to sign over his parental rights.In some agreements, the child support payments stop when a woman remarries but I believe the new husband has to adopt the children and therefore becomes their legal guardian. So, he would be responsible should that marriage go south.
There are so many deadbeats that shirk their responsibilities, the courts have to attempt to protect the children.
I'd say off hand that that would be very poor work by a lawyer if the child support payments stopped upon remarriage. Not even sure the courts would allow.
