Here's my understanding of this debacle. We did everything legal. But there was some backroom deal that the owners agreed to violate the anti trust laws and collude NOT to dump or front load contracts. The Cowboys and skins obeyed the law but they violated the shady backroom wink wink agreement. And now are being penalized by some pissy whiny owners complaining and the NFLPA won't challenge this because the league has agreed to add to the other teams cap numbers by 1.6 mil.

Q: Why isn't the union challenging this?

A: While this behavior seems to fit the very dictionary definition of collusion, as multiple teams were engaged in discussions to limit the earning potential of their employees and prospective employees, do not expect it to be challenged in court. The decision today, in which the Commanders were docked $36 million in cap space and the Cowboys $10 million, is the result of a settlement between the NFL and the NFLPA. One reason the union has no problem with it is that the money lost to the Cowboys and Commanders is not taken out of the overall 2012 spending pool — each of 28 other teams gets $1.6 million extra in cap room, so there's no net loss league-wide. Another reason the union won't push on it is because they agreed, as part of the settlement of last year's Brady vs. NFL federal lawsuit, to drop all pending legal action against the league. That included their claims that the league engaged in collusion in 2010.

Other teams also took advantage of the uncapped year but either didn't do it to the same extent or simply got away with it.


Well Adam if you know this. If you have the proof, why not send it anonymuosly to the right sports media people?

Also, there isn't a clearer example of fixing the market than telling teams they can't take advantage of the uncapped year when the whole point of having an uncapped year at the end of the CBA is to penalize the NFL and benefit the players. It provides an incentive to the NFL to get a deal done beforehand.

I gotta admit, after reading a bunch of posts concerns this topic over at Extremeskins and the posts made here at the Zone, this might be the one and only time in history of both franchises where the Cowboy and Commander fans are temporarily the "Twin sons from different mothers" as opposed to be the blood enemies they are 99.999% of the time.

Kinda funny really.

Makes sense since the players don't lose any money overall. Still dirty, but guess it's allowed since both sides agreed.

I'm guessing it's probably due to the fact that they have some idea of what they were looking to spend this year in free agency and they still can make some moves to clear salary cap space. The bottom line is that they must feel that they can take a $5 mil hit this year.

Can't we restructure a couple additional contracts to reduce the impact of the hit this year? Guys like Sensy or Spears, for example?

Actually, I think those two fan bases are nearly identical. They're in the exact same position.

Or maybe they restructure a couple of additional contracts to reduce the impact from say $5mm to $2-3mm this year?

Like I said and maybe it's because I'm not an against Jerry at all costs type guy but IMO everything they do in regards to this situation is because they have a plan. I doubt very much this situation cause Jerry to throw up his hands and cancel the season. How hard would it be really to get that 5 mil back this season and I ask because you know better then anyone here.

It would seem to me with a little nip here and tuck there we are back at square 1 and planning the same approach to tomorrow as we were 24 hours ago.

Either way, it still takes $5 mil of firepower away, because we could have used that restructuring to add to our cap budget to sign more players instead of doing it to pay a debt.
