When judges can never agree on what the law is, is there really law?

This is turning into Texas judges versus New York judges.

Yes, whatever courtroom your case is heard in decides what the law is for you.

Is it possible the hearing comes and Zeke could miss the end of season and or playoffs?

Doubtful. If Mazzant sides with Zeke and the NFLPA, the 5th circuit courts are slow, and by the time a court date is set, and motions filed, and time given for both sides to prepare. It won't actually be heard until next Spring.

This is just from different things I read that will be the most likely to happen.

From a marketing standpoint, it benefits the NFL to speed this up because if they are to lose (which you also hedge and prepare for), losing can be hidden to fans much easier DURING football season when theyre distracted versus the offseason where every tidbit of information is huge to fans.

This is no different than anyone expected. The NFL is hurt that they can't do anything they want and are concerned this will set a precedent for future cases. The fact our legal system has to be tied up in this mess when there was already no charges is a waste of time and money for everyone.

I know it's probably foolish to consider, but wouldn't it be great if the NFL brass saw this for the opportunity that it is? They can let this case play out, LOSE, and then declare that the NFL is out of the business of adjudicating cases which the legal system has already declared that there is no case.

I mean this was expected.

This isn't about Elliott really anymore. This is solely about protecting the power of the Commissioner now. If they lose this case, it erodes his control.

This! Truly amazing but sad and pathetic case where Goodell knows he is wrong but instead of admitting guilt and walking away, he doubles down to prosecute an innocent person just purely out of spite, power/control, and an infantile tantrum.
This should get even uglier because clearly Goodell isn't going to walk away from it even though he knows the process was messed up, Zeke is probably innocent, and at this point he will not score any points with any women's DV groups.

I'd say there hasn't been any recent cases where there was such a rush to indict despite overwhelming evidence to ththe contrary...but I would be wrong and I don't want to get banned

This ties into a point I made last week. So much of the judicial system, and therefore our laws, is virtual randomness. Tom Brady lost the league's CA2 appeal last year 2-1, and that ruling is now binding in the entire 2nd Circuit. However, fact is the appeals judges were selected in an (effectively) random manner and I have no doubt there exists 3 judge combos which would have given Brady the win and therefore changed interpretation of arbitration law in the 2nd Circuit considerably.

It seems to me that the wording Mazzant used and the scolding was so severe that they basically already know they will lose the case in front of him. I don't see anyway the injunction is lifted. Mazzant has already basically taken the case. Is the appeals court going to say Zeke needs to serve the suspension while he awaits the court trial? That's highly unlikely. So now the NFL has to wait for this hearing and then wait for the actual trial and then wait for the appeal hearing of that. This is going to take longer than the offseason.

Wrong. And it wouldn't matter, anyway - we're not at the appellate phase of this case yet, and won't be until next summer.

Yes they are but it's not an appeal of the case, it's an appeal of the injunction. That's very unlikely to succeed and even an expedited appeal could takes months to be heard.

Not necessarily.

But it's interesting that they would appeal a preliminary injunction.

You're appealing what essentially works as a stay of proceedings. So the NFLPA alleges harm that needs to be litigated, the judge agrees, and you as the respondent say "no - we need to re-institute said harm and force the petitioner to wait for adjudication".

It's stupid - if they win the appeal and the case goes to trial later, Zeke can't get back the games played (he'd be able to request monetary damages if he won). No judge is going to let this happen. The harm to Zeke/NFLPA/Dallas is inordinately larger than any potential harm the NFL would suffer from Zeke playing while his suspension is put on hold.
