Yeah I edited my post with that, too. But if he wants to go into this program and wants to use something other than the failed test by the courts, then he could submit that info as evidence.

I knew what you meant, but I wonder why you don't consider indefinite a formal suspension. IMO, that's as formal as it gets. That means Goodell can change his mind tomorrow or 10 years from now. Odell Thurman was technically suspended for a year and he's been out of the league for two years.

Just the way I process things, I look at formal as having a formal amount of time. I mean i know he is suspended and all. Just with a date such as 1 year I look at as more formal.

Although I am aware that the date does not mean much when it comes to applying for reinstatement

Hey guys I found out a little something from one of my fraternity brothers....what are your thoughts to this?

That based solely on my own experience, frat brothers are not the most reliable news source.

Sorry BigD if someone failed a test that would leave a paper trail which equals to a history....It doesn't have to be multiple instances, all it takes is one.....Just like on an employment application it asks you "have you ever been convicted of a felony or a misdemeanor"....it doesn't say anything about how many......

Do you really believe the BOP who deal with big time drug offenders daily is going to look at one failed drgu test for pot by a rich NFL player and say "yup that shows a history of substance abuse" If you do thats fine, I dont think so though

I pretty much trust this one, he worked along side another fraternity brother of mine Johnny Cochran....

Fair enough but it certainly lends to that. All he has to say is that he cannot control his dreadful marijuana addiction and that is why he was getting high while awaiting sentencing.

OR it shows he is an idiot that thought he could get away with it.
it shows that he has some sort of drug history thus his eligibility.

He is not eligible unless the BOP determines him to be eligible, I doubt they do

thats how fair, evenhanded leadership does. We on the other hand have Roger Goodell.

He can and will do whatever he wants on the whims of what garners the most revenue. If the mob says kill then he will kill so he can get 70 cents for every cable subscriber.

I'm just thinking of the hypothetical BigD....for example if the league turned over any evidence of him testing positive or if there was ever any other instances when he was in college.......I deal with people that smoke marijuana everyday and if you look at Vick's lips, and eyes you can see some of those same traits that I see daily....

Of course you doubt it cause you want him burned at the stake. Fortunately for Vick he has the best legal counsel money can buy.

Normally the idiots who think they can get away with it are the ones with drug problem. Maybe thats just me but you keep on willing it.

This is actually such and easy case to make. "Youre honor, i just cant stop smoking the weed!!! Its got its hold on meh."

Hopefully this goes down in the offseason so we can get the full fury of the DVDS whipped up. I know WG is looking forward to it.

Personally, at this point, it doesn't matter to me whether he gets into this RDATP or not and getting his sentence reduce result of getting into the program. I'm just trying to understand if he legitimately qualify for the program. Based on what info is available, it doesn't seem so, perhaps some one with more info could enlighten me.

Hint: Yes he is

Vick's attorney, William R. "Billy" Martin, announced Monday that the quarterback would plead guilty to the federal dogfighting charges and is "prepared to take full responsibility for allowing any and all of this to happen." Vick is scheduled to appear next Monday in U.S. District Court in Richmond. Sources familiar with the case, who spoke on condition of anonymity because the deal is not final, have said he is expected to plead guilty to a single conspiracy count and that the recommended sentencing range will be 12 to 18 months in prison.
You might want to reread what you posted.... and what BigD posted above.

He is not going to get any time off. That program is for habitual drug users with a history of doing drugs and getting caught. Vick does not in any way shape or form fit that description. Not to mention I do believe that JUDGE has final say and no way is he going to let vick get any slack.
Fuzzy, you lose here.

I want him burned at the stake? Quite a leap you made to that. I look at he situation and facts we know logically and come to a conclusion, You then claim I want him burned because I dont agree with you?

It seems you have a problem with those who do not agree with you.

That best legal counsel money could buy couldn't keep Vick out of prison, nor could prevent judge from giving stiffer sentence then what the DA recommened.

If a person is guilty and admitted to guilt then those high-powered lawyers can't do much for you.

Fuzzy, he lied to everyone and now suddenly the judge is going to believe him?
Fuzzy, you probably think OJ was innocent, or got a raw deal, right?

There was the infamous water bottle incident which was a drug related arrest and he has a documented positive result. Youre a lawyer, how hard do you think it would be to plead that to the board or whatever oversees this type of thing?
The Feds are known for being strict. I mean look at how much of his sentence he would have to serve without this. 85% at least, and that's giving him credit for good behavior.

The BOP is a group of people who's experience stems from their work in the prison system I'm sure. They're probably not people from the legal system.

I know that when our clients start asking when they'll be paroled, we have to tell them that we don't have control over that stuff. It all depends on what the prison and the Parole Board thinks, and how you behave yourself when you get in there. Admittedly, Vick's counsel probably has more influence because of their stature, but the BOP isn't something that I would think normally gives a whole lot of deference to what an inmate's legal counsel is pushing for.

ahh another one of those that wills things to happen.

last time i checked he was smoking pot while he was undergoing drug testing. Most people without an axe to grind would see that as a problem involving drugs.

Lets be quite frank here. This is Mike Vick we are talking about who grew up in a seedy part of VA and was actively participating in illegal activities, he was found in the airport with a waterbottle designed to smuggle things, his brother was a notorious pothead, and he has a positive drug test.

Yet somehow you guys come to the conclusion that he hasnt been smoking weed for the majority of his life. You guys are awesome.

That's the problem with our legal system Burm....I can't remember if it was you or Doc I was talking to one time on the ole ESPN Boards when we were discussing ways people get out the military and or beat the legal system......It happens and lawyers know the loopholes.
