He said the only contact he may have made was trying to get out the door

I don't think he admitted holding her down by the head....... that is the whole disputed charge

A prosecutor is not going to file charges unless their is enough evidence. If he admitted to physical contact that is enough to charge him. If she accused him of grabbing her neck and then he told the responding officers that he "maybe" have grabbed her neck, I am guessing this prosecutor thinks that is enough to warrant charges.

RKG = right kinda guy when a game starts (not so much the other 165 hours per week during the NFL season)

Cowboys rookie Jourdan Lewis to stand trial for domestic violence charge

ANN ARBOR, Mich. -- Dallas Cowboys rookie defensive back Jourdan Lewiswill stand trial for one charge of domestic violence next week.

Lewis attended a pretrial hearing Thursday morning, where he and his attorney made it clear they intended to fight the charge.

He was charged with the misdemeanor in March after a late-night altercation with a woman who was his girlfriend at the time. The woman told police that Lewis grabbed her by the neck and held her to the floor for roughly three seconds before leaving the apartment they shared.

Lewis said any contact he had with the woman was made in an attempt to leave the apartment.

Police said they saw no visible injuries when they arrived at the scene.

"Some cases have to be tried," said John Shea, Lewis' attorney. "This is one of them."

Thank you for your response. I don't know Michigan law. I do know Texas law and all of my comments in this thread are based on Texas law. DV is not a separate crime. DV only enhances the possible consequences of the crime charged.

As far as "evidence" goes, her testimony is evidence. Evidence need not be physical. The jury is free to believe all, part, or none, of her testimony. (And his for that matter). No other evidence is required by law.

In the federal legal system they use "sentencing guidelines" that narrow the punishment and leave little discretion to the judge. Most states do not have such guidelines. Jail, or fine only is stictly up to the one who imposes sentence within the statutorily authorized range of punishment.
With the fact that there were no marks or anything of that sort, would it not essentially just be his word against hers? I know in Canada men are behind the 8 ball immediately after an accusation. So I am just curious how it works in Texas

Yes, it would just be his word against hers. But if a jury believes her, that is enough for a conviction. Another example/hypothetical: you are getting out of your car In a parking garage. Somebody sticks a gun in your face and demands your money. Wisely, you give him your money and he runs away. You look around and there is nobody else in the garage. You call the police and as they arrive you see the gunman and point him out to the police. They stop him, search him, and find money but no gun. He says the money is his. The police and the prosecutor believe you. Should they let the guy go without making him face a jury? Criminals choose when and where to commit the crime. One witness is enough to convict someone IF the jury believes that one witness.

If Goodell is able to suspend players for incidents that occurred before they got into the league, then I want to see every single player who had incidents in college suspended. Starting with Joe Mixon, who was actually on tape like Ray Rice.

That's not true. I was arrested for assault on a female and at court the girl said she didn't want to file the charges that I never assaulted her but the D.A went on with the case. I took it to trial and won but the point is they can still go through with the charges either way with or without the evidence

Again, you said he admitted to holding her down........ that is what I disputed and nothing you posted backs up that statement

Well the cop could have tried to lead into it with questions such as "did you grab her by the throat?"

Lewis : "I don't know, maybe. I happened so fast. I would never hurt her. "

Cops should not ask specific questions. They should just take notes on what went on as detailed as possible without leading with questions such as "did you grab her by the throat?"

The state can go to trial even if the victim does not want to follow through, but they need evidence.

I'm not an attorney but i believe in your case the evidence would be her statement she gave the police.

Well the league cant really suspend him for this, so who cares at this point. What i want to know is, how was Conley off so quickly and Zeke is still being investigated? LOL

Because there are multiple owners who want Zeke punished no matter what and for a long long time.

So he held her down for three seconds and left. Sounds to me like she was going off and he did what he needed to so as to leave the room without being scratched, bit, whatever. And they call that domestic violence. What a pile of horse dung.

It's a woman's world. There are so many BS charges these days that I automatically assume the broad is lying until proven otherwise.

The horror of having your neck held for 3 seconds though. My thoughts are with her and her family.
