This is where the CBA hurts players. Courts are not going to intervene in disciplinary actions that were collectively bargained. His best chance is defamation/slander but it's a high standard.

You'll need to do some research.

Uh it is the law of our Government. Free speech? Nothing to do with private business. Innocent until proven guilty? Nope. That's a court of law. This is Civics 101.

The Constitution does not restrict government. Its our government and tells us what we can a cannot do. It affects all. Thus its the law of the land.

The sole purpose of the Constitution is to outline the functions of government, what it's powers are (granted to it by the people), and that anything not granted to it are restricted. The bill of rights are specific restrictions on government.

Zeke's DV case is different from all the others because it didn't even go through a court of a law. Not many people really knew about the details of this case until the league decided to suspend him.

How can the NFL charge him for something which he didn't do? The league doesn't have that range of power and certainly the CBA doesn't give that type of power to the commissioner.

Innocent until proven guilty stands for something in this country. If it didn't, than the league can accuse anyone of anything. Like Zeke is a child molester and a rapist. This is not like the Brady case because his was nothing more than a conduct policy. This is a DV policy and it should be proven in court that Zeke did something before the league level any charges against a player.
I'll agree with your sentiment, but fyi almost all of the recent NFL DV cases never made it to court.

They'll intervene where a U.S. Citizen's right to a trial and "innocence until proven guilty" is thrown aside in a move made strictly for appearances and courting public opinion.

This isn't deflating footballs, this is being punished as a criminal without a trial.
I hope you are correct but I believe a judge will look at this through the lens of the CBA which gives the commissioner the right to discipline players. They may argue flaws in the process but I'm not sure how compelling those arguments will be. Another poster enumerated the possibilities along this line.

It should matter because cases like this sets a precedence for others. For me it is not about Elliott being a Cowboys, heck I have leaned on the side of the NFL on most suspension even those pertaining to Cowboy players as long as their is clear cut prove of a violation. However when a player can get suspended based on she said despite overwhelming evidence against her then it is an issue and should be an issue for every player out there.
If there is overwhelming evidence Zeke never laid a hand on her, please share it.

She is scum, but that fact doesn't mean he is clean on this.

Lastly, you just answered your question. Innocent until proven guilty happens in a court of law. There is nothing stopping Zeke from taking the NFL to court. Nothing.

If a court of law deems that the NFL broke those laws they can overturn the suspension and/or fine the NFL and Goddell damages incurred onto Zeke.

Oh yes it is. The Constitution supersedes all laws in the United States of America. If you do business in the Unites States, you must abide by it INCLUDING the NFL.
The Constitution is the charter that guides the govt. It has little power over individuals and private entities. For example on public land (land owned by or leased by the govt) you can say whatever you want as long as it does not incite a riot and nothing the cops can do except tell you to move along. But lets move this to your job, you are in your cubical and you call the CEO of your company a ****** moron that should strangle himself, you get fired, you would not be able to take your employer to court for violation of your 1st amendment right. The only entity not allowed to infringe on any right enumerated in the Constitution is the gov't (local, state, or federal)

Violating a company policy is not equivalent to breaking the law.

NFL players signed off on this policy.

A court case would go similar to Bradys case.

Regardless it's a win for the NFL because in the public eye and the image they're attempting to protect for all invested they exhausted every effort to discipline the player.

Umm Greg Hardy's case went to court. It was dismissed. Jordan Lewis's case also went to court for DV. It was dismissed also Based on the suspension that Zeke got Jordan Lewis can still be punished by the league.

Ray Rice case also went to court. So was Adrian Peterson's case. Josh Brown's is the only case that I can think of that didn't go to court. But there was a ton of evidence that he already was an abuser.

Whats ironic about the Josh Brown case was that the NFL never saw his police records. They didn't even attempt to look into it before giving him a 1 game suspension. Its probably the same with Zeke's case. The NFL probably didn't look at the report. They just hand a a 6 game suspension and call it a day.

I wonder how 4 Investigators from the NFL came to a unanimous decision there was enough evidence to violate the personal conduct policy?

The commissioner has the rights to discipline players based on infractions such as DV. The CBA does give him that. However, the courts are the only entity allowed to determined if the law was broken or not based on their judgement on evidence provided by both opposing parties. The CBA does not give the commissioner that right.

If a court overturns the league's decision to suspend Zeke in which he committed no crime - therefore the league has no business in suspending Elliot. And if the court decides that what the NFL did was unjust and unlawful and caused substantial damage to the integrity and reputation of Zeke Elliott, they can pressure the NFL to comply with court decision to life the suspension or otherwise face fines given to Zeke.

Which is exactly why he made that statement. As far as he is concerned Zeke did it and nothing will change his mind.

Easy. They didn't look at the evidence and that they already decided to punish Zeke whether he's guilty or not.

Here is what it says about the Constitution:

This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any ...

Basically, the Constitution is the supreme law of the land. All courts of law have to abide by it. If Zeke's case goes to court, the Constitution will supersede whatever law that the NFL has.
