No, I don't think so. They need to consent to be taped and they need to consent to have the tapes released to the public unless forced to do so by legal means.

Where are you getting that from? If that is true, it will certainly change how I view some of these matters, but I haven't seen any such report anywhere.

It is nice that your focus in on "this was private" not "there is no place for racists owners in the NBA"

Your argument seems to be that we used to ostracize people who held view that supported not discriminating against people so we should allow Sterling to be a racist. Nice logic.

The league is doing what is best for Sterling and the Clipper franchise. His association will destroy that team and bring down the league as a whole. He has to go.

None of this is going to stop Sterling from being a racist. Racism is based on what is in your heart, not what is on your tongue.

In this instance, Sterling got what he deserved.

The concern Cuban and a few posters have here is what if something like it happens again but it's an offence not as clear-cut and universal?

Like I said before, if everything any of us ever said was recorded and broadcast publicly, I doubt anyone would stand up to such scrutiny.

Well, for clarity, he knew he was being recorded. It was done with his consent.

I long gave up on predicting how courts will work, but it is hard to imagine this sticking.

In essence, a person is being penalized for his thoughts.

Long ago, if people openly expressed support for homosexuality, or interracial marriages, they were publically ostracized for sharing thoughts so outside the realm of acceptable thought.

You are doing the same. the difference is not as great as you think it is. Someone said things that the public at large find to be disgusting and the pitchforks are gathering.

It's more than "his thoughts" when he instructed others to choose their guests based on race.

He's being punished for his prejudices, not his beliefs. And he should be

He's free to "believe" what he wants and the rest of society is free to move on without him.

The 31 year old woman who illegally taped her 80 year old boyfriend and then leaked those tapes to the media claims he knew he was being taped.

Anyone who believes that is welcome to purchase some very valuable swampland I am currently selling.

Right. Use the part of your brain that does logic here. If this requirement is in fact true, anyone ever caught on tape can sue multiple sources for the release. Yet sources such as TMZ remain in business and hugely profitable. Hmm. Logic says you are wrong.

I've said it like three times in this thread, but nobody wants to listen to the lawyer -- when you collectively bargain, you give up a lot of the rights (and in turn, gain new rights) within and outside of the boundaries of the law.

The only thing they can't do is "force" him to sell it. Unless they vote to terminate the Clippers franchise, but that's taking a scorched earth approach that would be more trouble than it's worth.

Sterling's best bet? Sell the team to Magic Johnson and his investment firm.

There's an article I saw somewhere that says that owners can be forced to sell. Although I think it applies to financial reasons, so maybe not in this case.
